Hosting Services Agreement

Capitalised terms used in this document that are not defined herein shall have the meanings set forth in the Core Hosting Terms of Service.

Scope and Applicability

If the Service pertains to storage and/or transfer of material supplied by the Customer to third parties (web hosting or email services), the provisions in this section shall apply. Core Hosting offers various hosting services, including but not limited to shared hosting, WordPress hosting, VPS hosting, and other web hosting solutions as described on the Website.

Description of Services

Core Hosting offers varying plans of hosting services:

  • Shared Web Hosting: Your site is placed within one or more servers and resources are shared between many customers on the same servers; however, your site is given a unique address (DNS).
  • Virtual Private Server (VPS): You share a server with other customers, but you have full control over your server space and the complete configuration of your virtual instance on the server. You have administrator (root) access and a dedicated IP address.
  • Dedicated Servers: You have exclusive use of physical server hardware with full administrative access and control over all resources.

Technical Responsibility

Core Hosting is responsible for the technical infrastructure (including, depending on the configuration of the Service: power, cooling, network connectivity, and hardware; virtualization layer; operating system; and/or application software). The Customer is responsible for everything on top of that infrastructure, including the Customer Data, website content, configurations, and any software or applications installed by the Customer.

Resource Usage and Fair Use

Hosting services are subject to fair use policies. The Customer agrees not to use excessive server resources in a manner that negatively impacts other customers. Core Hosting may impose limits on disk space, bandwidth, CPU usage, memory, entry processes, active processes, and other resources as specified in the service plan.

All hosting plans are subject to the following limitations (these may vary by plan):

  • Inode count (number of files and folders)
  • Database size and number of databases
  • CPU power and RAM allocation
  • Entry processes and active processes
  • Email sending limits
  • FTP account limits
  • Cronjob limits

In the event plan limitations are exceeded, the Customer may need to reduce the number of files or database size, the site may slow down or not be served until resources are released or more resources are added, and the site may be temporarily or permanently suspended, in Core Hosting's sole discretion. More resources may be added at any time by upgrading the plan.

Core Hosting reserves the right to change plan limits at any time. Such changes shall be posted on the Core Hosting website and communicated to affected customers where practicable.

Shared Hosting Resource Limits

Shared hosting plans are subject to resource limitations across the following parameters (specific values vary by plan and are detailed in the service description on the Website):

  • Disk space
  • Traffic (bandwidth)
  • Databases and database size
  • Database users
  • FTP users
  • Websites and domain names
  • Mail domains, mailboxes, and mailbox size
  • Emails sent per hour
  • Cron jobs
  • CPU time and RAM
  • Entry processes (EP) and user processes (NPROC)
  • I/O limit
  • MySQL connections and MySQL queries
  • Other parameters at Core Hosting's discretion

These limits are enforced using LVE (Lightweight Virtual Environment) and CloudLinux technologies to ensure fair resource distribution among all customers on shared hosting servers. Exceeding these limits may result in temporary resource throttling or suspension of service until usage returns to normal levels.

Backups and Data Restoration

Core Hosting makes backup copies of Customer Data for disaster recovery purposes in accordance with its internal policies. Backup frequency and retention periods vary by service type:

  • Shared hosting: Weekly backups retained for 14 days
  • VPS services: Backups retained for 3 days
  • Dedicated servers: No automatic backups provided (Customer must arrange own backup solution)
  • Colocation services: No backups provided (Customer is solely responsible for all backup arrangements)

Core Hosting's backup service is provided as a courtesy and may be modified at any time at Core Hosting's sole discretion.

Core Hosting is not obliged to make or keep backup copies of Customer Data for any purpose other than disaster recovery, unless otherwise agreed in a Service Level Agreement (SLA). If backup copies exist at the time of any accidental loss of or damage to original Customer Data, then Core Hosting will make commercially reasonable efforts to restore the lost or damaged Customer Data. If the loss or damage occurred through no fault of Core Hosting, then Core Hosting may charge the Customer a reasonable fee for data restoration.

Customer Responsibility: While Core Hosting may perform regular backups of Customer Data, the Customer is solely responsible for maintaining independent backups of all Customer Data. Core Hosting does not guarantee the availability, completeness, or recoverability of backups. The Customer undertakes to make with sufficient frequency backup copies of the files kept on the server and keep the software installed by the Customer updated in order to ensure its security. The Customer shall be solely responsible for undertaking measures to prevent any loss or damage to website or server content, and to maintain independent archival and backup copies of website or server content.

Software and Scripts

The Customer may install and use software and scripts on hosting services, provided that:

  • Such software and scripts do not violate these Terms or applicable laws;
  • The Customer has all necessary licenses and permissions to use such software and scripts;
  • Such software and scripts do not compromise the security or performance of Core Hosting's systems or other customers' services;
  • Such software and scripts do not cause excessive server load or resource consumption.

The Customer shall not use on the server any software, scripts, programs or applications which burden, disturb or damage the normal operation of the server. Core Hosting reserves the right to remove or disable such software, and the Customer undertakes to remove these at the latest within twelve (12) hours after notification by Core Hosting.

Use Restrictions

The Customer must ensure that all content and activities on the Services comply with these Terms and the Acceptable Use Policy. The Customer is solely responsible for all content hosted through the Services. Prohibited content types, activities, and service configurations are set out in the Acceptable Use Policy.

Email Services

Email services provided as part of hosting packages are subject to fair use policies and anti-spam regulations. The Customer agrees not to use email services for sending unsolicited bulk email (spam) or for any purpose that violates the Acceptable Use Policy.

Email services are subject to the following limitations:

  • Sending limits per hour/day as specified in the service plan
  • Attachment size limits
  • Mailbox storage limits
  • Number of email accounts per hosting plan

Security Obligations

The Customer shall be solely responsible for ensuring the security, confidentiality and integrity of all website or server content transmitted through or stored on Core Hosting's servers. This includes:

  • Maintaining secure passwords and access credentials;
  • Keeping all software, scripts, and applications up to date with security patches;
  • Implementing appropriate security measures for any applications or databases;
  • Monitoring account activity for unauthorized access;
  • Promptly reporting any security incidents to Core Hosting.

Server Migration and IP Addresses

The Customer acknowledges and agrees that as a normal course of business, it may be necessary for Core Hosting to migrate servers. As a result, even if the Customer has a dedicated IP address, the Customer may be assigned a different IP number. Core Hosting does not warrant that the Customer will be able to consistently maintain assigned IP addresses.

Core Hosting will make commercially reasonable efforts to notify customers of planned migrations in advance where practicable.

Shared Hosting Specific Provisions

The following provisions apply specifically to shared hosting services:

  • Inbound UDP traffic is not supported in shared hosting environments;
  • Root or administrative access to the server is not provided;
  • Resources are shared with other customers on the same physical server;
  • Custom server configurations may not be available;
  • Certain ports may be blocked for security reasons.

VPS and Dedicated Server Specific Provisions

For VPS and dedicated server services:

  • The Customer has administrative (root) access and full control over the server configuration;
  • The Customer is responsible for server security, including firewall configuration, security updates, and monitoring;
  • The Customer is responsible for installing and maintaining the operating system and software (unless managed services are purchased);
  • Core Hosting provides hardware maintenance and network connectivity but does not manage the server software unless specifically contracted;
  • The Customer must comply with all security best practices and respond promptly to any security notifications from Core Hosting.

Colocation Services

Colocation services provide the Customer with rack space, power, cooling, and network connectivity in Core Hosting's data center facilities for the Customer's own equipment. The Customer retains full ownership of all hardware placed in the colocation facility.

Equipment Delivery and Installation: The Customer is responsible for delivery of equipment to Core Hosting's specified location. Core Hosting will perform physical installation, cabling, and initial configuration as part of the service setup. The Customer must ensure equipment meets data center requirements (power consumption, dimensions, weight, cooling requirements).

Remote Hands Service: Physical access to the data center is not provided to colocation customers. All physical interventions (hardware replacement, cable changes, power cycling, etc.) are performed by Core Hosting's technical staff through the Remote Hands Service. Remote Hands requests must be submitted via the customer portal or support ticket system.

Customer Responsibilities: The Customer is responsible for:

  • All hardware maintenance decisions, parts procurement, and replacement hardware delivery;
  • Remote management, configuration, and monitoring of colocated equipment;
  • All software, operating systems, licensing, and security of colocated systems;
  • Ensuring equipment compatibility with data center infrastructure;
  • Timely response to hardware failures and provision of replacement parts.

Core Hosting Responsibilities: Core Hosting is responsible for providing the agreed level of power, cooling, network connectivity, and physical security as specified in the Service plan. Core Hosting will perform Remote Hands services as requested by the Customer. Core Hosting is not responsible for the Customer's equipment failures, data loss, or any issues arising from the Customer's hardware or software.

Equipment Removal: Upon termination of colocation services, the Customer must arrange for equipment removal within 30 days. Equipment not removed within this period may be disposed of at the Customer's expense.

Third-Party Software

"Third-Party Software" means any software or application developed and owned by a third-party provider that Core Hosting may contract with from time to time.

Core Hosting reserves the right to modify, change, or discontinue any Third-Party Software at any time, and the Customer agrees to cooperate in performing such steps as may be necessary to install any updates to the Third-Party Software. The Third-Party Software is neither sold nor distributed to the Customer, and the Customer may use the Third-Party Software solely as part of the Services. The Customer may not use the Third-Party Software outside of the Services.

If the Third-Party Software is accompanied by or requires consent to a service or license agreement from the third-party provider, the Customer's use of the Third-Party Software is subject to such service or license agreement. The Customer may not download, install, or use any Third-Party Software that is accompanied by or requires consent to a service or license agreement from a third-party provider unless the Customer first agrees to the terms and conditions of such service or license agreement.

The Customer may not:

  • Remove, modify, or obscure any copyright, trademark, or other proprietary rights notices that are contained in or on the Third-Party Software;
  • Reverse engineer, decompile, or disassemble the Third-Party Software, except and only to the extent that such activity is expressly permitted by applicable law.

The Customer acknowledges and agrees that third-party providers (and their affiliates and suppliers) make no representations or warranties about any Third-Party Software offered in connection with the Services, and expressly disclaim any liability or damages (whether direct, indirect, or consequential) arising from the use of the Third-Party Software. Any Third-Party Software will be supported by Core Hosting and not by the third-party providers (or their affiliates or suppliers).

Term and Termination

The hosting service is for an indefinite term, unless Core Hosting and the Customer agree otherwise in a specific service agreement.

Upon expiration or termination of hosting services, the Customer acknowledges and agrees that:

  • The Customer must discontinue use of the Services;
  • The Customer must relinquish use of the IP addresses and server names assigned in connection with the Services;
  • The Customer must point the domain name system (DNS) for domain names away from Core Hosting's servers;
  • The Customer is responsible for moving website or server content off Core Hosting's servers prior to termination;
  • Core Hosting will not transfer or FTP website or server content to another provider;
  • If the Customer fails to move website or server content off Core Hosting's servers prior to cancellation, all such content will be deleted and Core Hosting will not be able to provide a copy of such content;
  • All free products or services provided as part of the hosting package will be cancelled or revoked.

Refunds upon service cancellation or termination are subject to Core Hosting's Refund Policy.

Data Location

If Core Hosting and the Customer have so agreed, then Core Hosting shall ensure that the Customer Data shall, for the purposes of provision of the Service, only be stored and processed within the territory set forth in the Service Agreement. Unless otherwise specified, Customer Data is stored within the European Economic Area.

Performance and Uptime

Core Hosting strives to maintain high availability of hosting services. However, the Customer acknowledges that no hosting service can guarantee 100% uptime. Scheduled maintenance will be performed during low-traffic periods where possible, and Core Hosting will make reasonable efforts to notify customers of planned maintenance windows.

Service Level Agreements (SLAs) with specific uptime guarantees may be available for certain service plans and will be detailed in separate agreements.

Server Maintenance

For the purpose of providing stable services, Core Hosting shall maintain servers regularly. Core Hosting shall notify the Customer of any scheduled server maintenance and improvement works which may disturb the ordinary use of the services at least five (5) calendar days in advance. In urgent cases, maintenance works and configuration changes may be done without notifying the Customer in advance.

Core Hosting shall repair any server failures within a reasonable time, but not later than within three (3) working days from the time the failure is reported or detected.

Service Suspension

Core Hosting is entitled to immediately suspend the provision of services to the Customer if:

  • The software, scripts, or other applications used by the Customer cause failures, overloads, or hinder Core Hosting in any way upon provision of services;
  • Internet attacks are aimed at the Customer (including denial-of-service attacks, i.e. DoS and DDoS attacks);
  • The Customer, through their actions, generates excessive load on the Internet channel, processor, memory, disk, or other shared resources;
  • The Customer does not comply with instructions from Core Hosting;
  • Payment for services has not been received by the due date;
  • The Customer violates these Terms, the Acceptable Use Policy, or applicable laws.

Core Hosting will make reasonable efforts to notify the Customer before suspension where circumstances permit, except in cases where immediate action is required to protect systems, other customers, or Core Hosting's network.

Service Billing and Expiry

Hosting and server services are billed in advance according to the billing cycle specified in the service plan. An invoice is issued 14 days before the service due date. If payment is not received by the due date, the service will be suspended.

The service will remain suspended for an additional 14 days, during which the Customer may make payment to reactivate the service. If payment is not received within 28 days from the original due date, the service and all associated data will be permanently deleted without further notice.

The Customer is responsible for ensuring that payment information is current and that invoices are paid on time. Core Hosting is not responsible for service interruption or data loss resulting from non-payment.
